1. Preamble

1.1. The present Terms & Conditions (“Terms & Conditions”) governs your relationship with the www.principlesforpeace.org website (the “Website”), which includes the Peace Nav-igator Platform, an AI-powered platform hosted on the Website (the “Platform”), oper-ated by Principles for Peace Foundation (“Principles for Peace”, “us”, “we”, “our”), whose headquarters are located at Chemin Eugène-Rigot 2C, 1202 Geneva, Switzerland.

1.2. Please read these Terms & Conditions carefully before using the Website and our Plat-form. Your access and use of the Website and Platform are conditional upon your ac-ceptance of, and compliance with these Terms & Conditions.

1.3. By browsing our Website and/or our Platform, you agree to be bound by these Terms & Conditions. You also warrant that you have the legal capacity to accept our Terms & Conditions. It is your responsibility to ensure that you have understood our Terms & Conditions and their scope.

1.4. If you do not consent to these Terms & Conditions, we kindly ask you not to use our Website or Platform.

2. Access and use

2.1. You may access and use the Website and Platform in various ways, as outlined in the sections below. The scope of access, available features, and any associated rights or restrictions depend on the plan (for example free or paid plan) or type of access (for example free access or through an account) you select, in particular when using our Platform.

A) Free access
2.2. You may access and use the Website and Platform to the extent made available by Principles for Peace and in accordance with the provisions of these Terms & Condi-tions. You may use the Website and certain features of the Platform without creating an account. Access without login may be limited by Principles for Peace at its sole dis-cretion to what Principles for Peace agrees to make available with free access.

B) Free account
2.3. You may register for a free account to access certain features and content on our Plat-form. Free account usage is subject to these Terms & Conditions. Registration does not require payment.

C) Paid Plan
2.4. Principles for Peace may, at any time and at its sole discretion, make access to addi-tional features and content, or give access to previously free features and content, conditional upon completion of paid subscriptions (“Paid Plan”). Use of any Paid Plan content will be subject to the terms specified at the time of subscription, including any expanded rights or obligations. Nothing in these Terms grants you rights to Paid Plan content until you subscribe and agree to the applicable terms.

D) Registration wall requirements
2.5. Certain features or content of the Platform may require prior registration. To access these features or content, you are required to (i) provide accurate and complete regis-tration information, (ii) create an account with a valid email address and password, (iii) agree to these Terms & Conditions, (iv) abide by any other instructions provided at the time of registration.

2.6. Any personal data collected during registration will be processed in accordance with the Privacy Policy.

2.7. Access, including accessible features and content, conditioned to prior registration may be subject to limitations on usage, as determined by Principles for Peace any time and at its sole discretion, and may change over time.

E) Account responsibility
2.8. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Principles for Peace immediately of any unauthorized use of your account.

2.9. You are solely responsible for any content, data or information you enter or transmit on our Platform’s chatbot in particular with regard to its accuracy and legality (including compliance with third party rights, confidentiality and data protection).

 

 

3. Restrictions on use

3.1. The Website and Platform shall be used in good faith by you. As such, the use of the Website and Platform is in particular, restricted as follows:

a) You shall not use the Website or the Platform, including generating content through the Platform’s chatbot, for any commercial, revenue-generating, or profit-driven purpose. Use of the Website and the Platform is permitted solely within a charita-ble or nonprofit context and purpose, including an academic purpose.

b) You shall not reproduce, modify, prepare derivative works based upon, sell, resell, license, sublicense, distribute, make available, rent or lease the Website, including the Platform, or any of its components, feature, function or interface, or include the Website or Platform in an offering.

c) You shall not (i) permit direct or indirect access to or use of the Website or Platform in a way that circumvents a contractual usage limit, (ii) attempt to gain unauthorized access to the Website or Platform, including their related systems or networks, (iii) access the Website or Platform in order to build a competitive product, Website or Platform, (iv) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Website, including the Platform, or (v) decompile, reverse engineer or disassemble the Website or the Platform or portion thereof.

d) You shall not use the Website or Platform in a way which threatens the security, in-tegrity or availability of the Website or Platform; you shall in particular not use the Website or Platform to (i) store or transit infringing, libelous, or otherwise harmful or unlawful material, (ii) store or transmit material in violation of third-party privacy rights, (iii) store or transmit malicious code, (iv) interfere with or disrupt the integri-ty or performance of the Website or Platform or third-party data contained therein.

e) You shall not use the Website, the Platform, or any data or information obtained from them for any offensive, abusive or unlawful purpose or manner, or in any manner that could cause harm to a third party or to Principles for Peace. In particu-lar, you shall not (i) incite or facilitate violence, or promote harm against any individ-ual, group or population, (ii) target or discriminate against any population, commu-nity, or individual (iii) misuse, manipulate, or misrepresent any conflict-related in-formation, (iv) engage in activities that could otherwise result in physical, psycho-logical, social, or economic harm, (v) violate the principle of “Do No Harm”, which governs all use of the Website and Platform.

f) Unless applicable law requires a higher minimum age, you must be at least 16 years old to use the website or platform.

 

 

4. Intellectual property

4.1. The Website, the Platform and their original content, including all content generated by the AI-powered Platform’s chatbot, features and functionalities are and will remain the exclusive property of Principles for Peace, its licensors or third parties as applicable. In particular, the corporate names, logos, distinctive signs, photos, source codes, ac-cessible via our Website and Platform, are the sole property of Principles for Peace and may not be used without the prior and written authorization of Principles for Peace.

4.2. The domain name on which the Website is hosted is our exclusive property. You are not authorized to link another site to this domain name without our authorization and/or to use or adopt a similar name for your own use.

4.3. Certain content on the Website and the Platform, based on open-source databases, and other publicly available data sources, may be the property of third parties. When using content generated by the Platform’s chatbot or third-party content from the Website or Platform, you must clearly indicate both the original source and that the in-formation was obtained from the Website or the Platform.

4.4. While Principles for Peace makes reasonable efforts to identify third-party content, it does not guarantee that all content is free from third-party intellectual property rights, and users are solely responsible for ensuring that their use of such content does not infringe upon any rights of third parties.

4.5. Subject to these Terms, Principles for Peace grants you a limited, non-exclusive, non-transferable license, revocable at any time, to access and use the Website and the Platform, including their content, data and information, solely for you to access, display and use the Website and the Platform for your personal use only (without the right of use by third parties). You are also authorized to make philanthropic, research, or edu-cational use of the content, data, and information accessible through the Website and Platform, provided that such use is compatible with applicable law, including the rights of third parties, which you are solely responsible for ensuring. Consulting and using the Website or the Platform does not grant you any intellectual property rights over any element appearing on the Website or the Platform.

4.6. When you use our Platform’s chatbot, the latter generates responses based on public-ly available or open-source data. By using our Platform’s chatbot, you acknowledge and agree that the information you enter may be transmitted to a backend service running on Google Cloud and forwarded to our AI service provider, OpenAI API or Az-ure OpenAI API, in order to generate responses, improve the Platform and your expe-rience using the Platform and we may store, reproduce and/or reuse this information, provided we comply with our Privacy Policy.

4.7. By providing any feedback, suggestions, or corrections related to the Website or Plat-form, you grant Principles for Peace a perpetual, irrevocable, worldwide, royalty-free license to use, modify, distribute, sublicense, and otherwise exploit such feedback, suggestions, or corrections for any purpose, including improving or developing the Website, Platform, or related services.

 

 

5. Disclaimer

5.1. Your use of the Website and the Platform is at your sole risk. The Website and Plat-form, including all content generated through the AI-powered Platform’s chatbot, are provided on an “AS IS” and “AS AVAILABLE” basis.

5.2. The information contained on the Website and on the Platform is provided without warranties of any kind, whether express or implied, including, but not limited to, im-plied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. We are not liable for any information or instructions gener-ated by the AI-powered Platform’s chatbot, and they do not constitute a contractual commitment on our part.

5.3. You acknowledge and agree that you do not necessarily have the ability to retrieve any content you may post on the Platform’s chatbot, nor do you necessarily have the abil-ity to obtain from the Platform’s chatbot a reproduction of a prior displayed content. We therefore accept no responsibility for any loss or damage resulting from the loss or alteration of such content.

5.4. Third-party content available on the Website or the Platform is the sole responsibility of the third party from which it originates. The presence of hypertext links on the Website or Platform to other websites does not guarantee the quality of the content of these websites or their proper functioning.

5.5. Principles for Peace and Principles for Peace’s employees, board members, agents, advisors, subcontractors and licensors do not assume any liability related to the use of the information contained on the Website and the Platform, and Principles for Peace or Principles for Peace’s employees, board members, agents, advisors, subcontractors and licensors may not be held liable for the inexactness, nor errors, omissions or modi-fication of content of the information available on the Website or on the Platform, in-cluding the content generated through the AI-powered Platform’s chatbot.

5.6. Principles for Peace, Principles for Peace’s employees, board members, agents, advi-sors, subcontractors and licensors do NOT warrant that:
(i) the Website and the Platform will function uninterrupted, secure or available at any particular time or location,

(ii) any errors or defects will be corrected,

(iii) the Website and the Platform are free of viruses or other harmful components,

(iv) the information contained on the Website or the Platform is accurate or exhaus-tive,

(v) the results of using the Website or Platform will meet your requirements,

(vi) the AI-generated content is correct, complete, or free of errors.

5.7. Principles for Peace may freely and at its sole discretion interrupt, suspend, or close access to the Website, the Platform and/or parts thereof from time to time, for a peri-od of time determined at its sole discretion.

 

 

6. Limitation of liability

6.1. Principles for Peace and Principles for Peace’s employees, agents, subcontractors and licensors shall not be liable for any damages, liability or losses arising out of:
(i) your use of or reliance on the Website and the Platform, in particular information made available on the Website or Platform by third-parties,

(ii) your inability to access or use the Website or the Platform,

(iii) any transaction or relationship between you and any third-party, even if Principles for Peace has been advised of the possibility of such damages,

(iv) any inaccuracies, errors, or omissions in AI-generated content, or

(v) any actions or decision taken based on information provided by the AI-powered Platform’s chatbot.

6.2. In any event, Principles for Peace and Principles for Peace’s employees, agents, sub-contractors and licensors shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with or otherwise resulting from any access or use of the Website or the Platform, regardless of the negligence (either active, af-firmative, sole or concurrent) of Principles for Peace, even if Principles for Peace has been advised of the possibility of such damages.

 

 

7. Data privacy

7.1. As regards the data privacy related to the use of the Website and the Platform, please refer to our Privacy Policy related to the www.principlesforpeace.org website, which includes the Platform, and our dedicated pages on social media.

 

 

8. Miscellaneous

8.1. These Terms & Conditions shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any dispute, con-troversy, or claim arising out of or relating to these Terms & Conditions, the use of the Website and the Platform, shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.

8.2. Our failure to enforce any right or provision of these Terms & Conditions will not be considered a waiver of those rights.

8.3. If any provision of these Terms & Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms & Conditions will remain in effect.

8.4. These Terms & Conditions constitute the entire agreement between us regarding our Website and our Platform, and supersede and replace any prior agreements we might have between us regarding the Website and the Platform.

8.5. We reserve the right, at our sole discretion, to modify or replace these Terms & Condi-tions at any time.

8.6. By continuing to access or use our Website and/or our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree with the new terms, please stop using the Website and the Platform.
